1. Terms of Use

General Agreement

• Using Shopkiper website, mobile site or app automatically enters into legally binding contract with Shopkiper.
• This website is controlled and operated by Shopkiper, and products are sold by respective sellers. Shopkiper itself is not the seller.
• Shopkiper reserves the right to change its terms of use at any time, without prior notice. Your continued acceptance of the updated terms will be deemed acceptable.
• The content on this website, including images, text, logos, videos, and graphics is owned by or licensed to shopkiper and may not be copied, reproduced, or used without permission.
• Website content is for personal, non-commercial, use only, copying, reproducing, uploading, transmitting or distributing. It is strictly prohibited.
• These terms shall be governed by the laws of India, subject to applicable law, the courts of Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or in connection with this website.

Registration & Account

• The shopkiper website can be browsed without registration. However, account registration is required for purchases or certain services.
• Users must be 18 years of age or older to register an adult. Guardian may register on behalf of a minor, on their own responsibility.
• The information provided during registration must to be true, correct and complete. Incorrect information may result in shopkiper suspending or terminating your account.
• You are responsible for maintaining the password and confidentiality of your account. All activities that occur under your account are your responsibility.
• Sharing your login ID or password with anyone else is prohibited. Notify shopkiper immediately of any security breach.
• A single person should only have one account, creating multiple accounts is a policy violation.

Prohibited Activities

• Using racist, hateful, sexual, or obscene language on the shopkiper platform, in listening on seller pages or in any public area is strictly banned.
• The platform may not to be used for fraudulent, false or misleading purpose. Knowingly making false orders or claim is prohibited.
• Collecting, harvesting or using any other user's personal information without their consent is strictly prohibited.
• Attempting to damage, overload, or impair the website or accessing it in any unauthorized manner is prohibited.
• The platform may not be used to send spam, bulk mail or chain letters.

Intellectual Property

• All original content and branding displayed on Shopkiper are either owned by Shopkiper or used under license from the respective owners. No third party may use such content without permission.
• To the fullest extent permitted by applicable law, users are responsible for their use of shopkiper and for ensuring, that any content, materials or actions, associated with their account do not infringe any third party, Intellectual property or privacy rights. Nothing in these terms shall be construed as a waiver of rights that cannot be waived under applicable law.
• The user shall not upload, post, submit, or otherwise use any content that infrings the intellectual property rights of any third party if any claim, notice, loss, damage, or legal proceeding arises from the user's violation of third party. Intellectual property rights or misuse of the website, the user shall be responsible for such claim and shall indemnify and hold harmless shopkiper and its owners from all resulting losses, liabilities and reasonable legal expenses, to the extent permitted by applicable law.

• Shopkiper is operated from India and the information, products and services available on this website are intended for users in India. Users accessing Shopkiper from outside India do so at their own responsible and are responsible for compliance with their local laws, to the extent applicable.

• Users shall comply with the Information Technology Act 2000 and all rules, regulations, and notifications issued there under as amended from time to time along with all other applicable laws while using Shopkiper.
• Users are solely responsible for complying with all applicable laws, rules, and regulations including central, state, and local laws while accessing or using Shopkiper.

2. Privacy Policy

Data Collection

• Personal Information: Name, email address, mobile number, address, billing information.
• Transaction Data: Purchase history, billing address, payment details, delivery address and order information.
• Automatically Collected: IP address, browser type, device type, operating system, and website usage patterns — all of this is collected without you saying anything.
• Cookies: The Shopkiper website uses "cookies" to analyze web page flow, measure promotional effectiveness, and for security purposes.
• Mobile Data: Your phone number and unique device ID may also be collected when you use the mobile app.
• Correspondence: If you send an email or letter to Flipkart, or a third party writes about you, that information is also stored in a specific file.

• Personal information is used to provide a safe, efficient and customized shopping experience.
• Providing Services: Processing Orders, collecting payment, arranging delivery.
• Dispute resolution: Your knowledge is useful in solving any dispute or problem.
• Marketing & Communication: Informing about online and offline offers, products, services and updates.
• Fraud Prevention: Detecting and preventing errors, fraud, and criminal activity.
• Analytics: Analyzing demographic and profile data — analyzing user activity for website improvement.
• Terms Enforcement: Enforcing your terms and conditions.

Data Sharing

• Personal information is retained for as long as necessary to fulfill the purpose or as required by law, in accordance with applicable laws -no more.
• Data may be retained in anonymised form for longer periods of time to prevent fraud or defend legal claims.
• Privacy Policy is subject to change at any time without notice – it is recommended to check back frequently.
• By using the Website, you are consenting to the collection and use of information in the Privacy Policy – explicitly.

3. Cancellation Policy

Cancellation Rules for Customers

• The order can be cancelled at any time before it is dispatched – through the Cancel button on the App or Website.
• The order will not be cancelled after dispatch (with self-service). However, you can refuse delivery at the doorstep.
• If the cancellation window has passed, a cancellation fee may apply in some cases – depending on your account history (returns, cancellations).
• Cancellation fee applies only to select products and select users – not everyone.
• There is no cancellation charge (in the free cancellation window) and the amount already paid is refunded within 5-7 business days.

Seller Cancellation

• If the seller cancels the order due to unforeseen circumstances, a full refund will be processed for prepaid orders.
• Orders cannot be cancelled once they are scheduled for delivery – even for the seller.
• Shopkiper reserves the right to impose reasonable cancellation-related charges or penalties on sellers for excessive, fraudulent, or avoidable order cancellations, subject to applicable law and platform policies.
